1. Overview

Welcome to ashacreativeco.com. By accessing this website and purchasing any services or digital content from Asha Creative Co., you agree to the following Terms & Conditions. These terms are intended to outline the rules, responsibilities, and protections in place for both you (the customer) and Asha Creative Co. (the service provider).

2. Services Offered

Asha Creative Co. provides custom AI-generated image design services and downloadable digital content for commercial use. This includes visuals such as t-shirt designs, wall art, poster art, greeting cards, book covers, clipart sets, Pinterest pin graphics, and photorealistic images. Additional service options may be offered as add-ons to enhance your results and delivery format.

All images are generated using AI tools and delivered in raw PNG format. Images are not upscaled, layered, or formatted for print unless explicitly stated.

3. Use of Generated Content

Once your final payment has been received and your digital images have been delivered, you are free to use those files for any legal commercial or personal use. This includes the right to:

▪️ Resell images as-is (e.g., in clipart packs, digital bundles, etc.)

▪️ Incorporate them into physical or digital products

▪️ Modify, crop, or overlay them as needed for your brand

Asha Creative Co. does not retain any ownership or impose licensing restrictions once the content is delivered and paid for.

4. Exclusivity Disclaimer

Due to the nature of AI image generation, exclusivity cannot be guaranteed. While your images are generated uniquely based on your prompts, similar results could be produced by other users using the same platform and similar input.

Example: If you request a wall art design that says “Positive Vibes Only” in retro script, someone else may independently generate something similar using their own prompt.

Asha Creative Co. does not resell your custom content — but cannot prevent the AI platform (Ideogram) from generating lookalike results for others. For more information, please review Ideogram’s Terms of Service.

5. Ordering Process

All orders begin with the submission of a no-obligation request form specific to the service you’re interested in. If your request is approved, you’ll be sent an invoice and a spreadsheet to complete with your content direction. Once your 50% deposit is received and your spreadsheet is submitted, work will begin. Final payment is due before delivery.

6. Payments & Billing

All payments are processed securely through Stripe. Asha Creative Co. does not accept PayPal, and no alternative payment gateways will be supported.

Any disputes or chargebacks must be handled directly between the customer and their financial institution. Asha Creative Co. is not liable for delays, access issues, or refunds resulting from payment processor issues.

7. Cancellations & Refunds

Once work has begun (after deposit and spreadsheet submission), orders cannot be canceled or refunded under any circumstance. This is because image generation incurs a non-refundable cost in both time and platform credits.

If a clear error has been made by Asha Creative Co. — such as missing or incorrect content — a significant discount on a future order (typically 30–40%) may be offered as a resolution. However, dissatisfaction based on personal taste or subjective expectations does not qualify for refunds or remakes.

8. Revisions Policy

Asha Creative Co. does not offer revisions — paid or unpaid. The labor and credits involved in “revising” an AI image are the same as starting from scratch. If the result reflects your original instructions and spreadsheet, it is considered fulfilled. If the result contains a clear mistake caused by Asha Creative Co., a discount may be offered for a new order.

9. Content Limitations

Asha Creative Co. reserves the right to refuse any request that includes:

▪️ Hate speech or discriminatory content

▪️ Political extremism

▪️ Graphic nudity or explicit material

▪️ Illegal or unethical content

▪️ Any prompt that violates Ideogram’s AI safety filters

Orders that fall into these categories will be declined. If an order is already in progress and is later found to breach these guidelines, it will be canceled with no refund.

10. Intellectual Property & Platform Limitations

All images are generated using third-party AI platforms (primarily Ideogram). While the prompts and concept development may be original, the resulting artwork is not protected by copyright in a traditional sense.

By using this service, you acknowledge that:

▪️ Your designs are not guaranteed to be one-of-a-kind

▪️ Similar outputs may be generated by others on the same platform

▪️ You assume responsibility for how your images are used or resold

11. Limitation of Liability

Asha Creative Co. is not responsible for:

▪️ Losses or damages from using or misusing delivered images

▪️ Customer error in uploading, printing, or publishing the content

▪️ Legal disputes arising from how images are applied after delivery

You agree to use all content at your own discretion and accept all risk.
